Abstract

dispute settlement conciliation labour dispute labour law institutional framework methodology United Kingdom of Great Britain and Northern Ireland USA Mediation Arbitration Australia
Shows how the extent to which conciliation and mediation processes are voluntary or compulsory varies from case to case. Finds that procedures followed tend to be less formal and legalistic in Great Britain than in the USA and much less so than in Australia. Although the penetration of third-party involvement varies, the authors conclude that it is alive and well in all three countries, and expanding in Australia and the USA.
